Section 1983 of the Civil Rights Act of 1871 provides those injured by a police officer or sheriff deputy a way to seek recovery of injuries, harms and damages.  That section provides: “Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress. …”

 

The primary purpose of Section 1983 of the Civil Rights Act is to provide a way to enforce the 14th Amendment to the Constitution’s protections of citizens against police or sheriff negligent tactics, misconduct and abuse, brutality, excessive or deadly force by shootings, tasers and beatings, as well as unlawful arrests and detentions.
